In the dynamic landscape of artificial intelligence (AI), two international frameworks have emerged to guide the development of ethical and responsible AI systems: the OECD AI Principles and the Child Rights by Design Principles.

In this blog post, I will explore how OECD and Child Rights by Design standards can be harmonized to develop ethical learning models and governance frameworks for AI products designed for children.

Background

The Organisation for Economic Cooperation and Development (OECD)

The OECD is an international organization comprising 38 member countries. These countries collaborate to develop policy standards to promote sustainable economic growth, prosperity, and well-being by sharing best practices and comparing experiences across various economic, social, and scientific areas.

Headquartered in Paris, France, the OECD's work in AI policy has global influence beyond its member states.

Child Rights by Design

Child Rights by Design is a product design approach developed by child rights advocates and digital technology experts. It's based on the UN Convention on the Rights of the Child and aims to ensure that children's rights are respected and promoted in the digital environment.

Various organizations, including UNICEF, have adopted this framework, which is increasingly recognized as a crucial consideration in developing digital products and services for children.

OECD AI Principles

The OECD Principles on Artificial Intelligence, adopted in 2019 and updated in 2024, provide a framework for innovative and trustworthy AI that respects human rights and democratic values.

These principles, the first to be endorsed by governments worldwide, offer concrete public policy and strategy recommendations. The 2024 update addresses privacy, intellectual property rights, safety, and information integrity challenges, especially in light of generative AI developments.

Critical aspects of the OECD AI Principles include:

  1. Inclusive growth, sustainable development, and well-being
  2. Human-centered values and fairness
  3. Transparency and explainability
  4. Robustness, security, and safety
  5. Accountability

The principles also emphasize the importance of fostering a digital ecosystem for AI, building human capacity, and international cooperation.

Child Rights by Design Principles

Child Rights by Design principles focus on creating digital products and services that respect and promote children's rights. These principles emphasize the importance of considering children's unique needs, vulnerabilities, and rights throughout the design and development process.

They aim to ensure that digital technologies, including AI, are safe, inclusive, and beneficial for children's growth and wellbeing.

Key aspects of Child Rights by Design often include:

  1. Privacy by Design
  2. Safety and Security
  3. Accessibility and inclusion
  4. Age-appropriate content and features
  5. Parental controls and transparency

Aligning Principles for Ethical AI in Children's Products

The OECD AI Principles and Child Rights by Design principles can be synergistically applied to design ethical AI learning models and governance frameworks for children's consumer products:

  1. Safety, Security, and Privacy: Both principles emphasize the importance of safety, security, and privacy. Designing AI for children translates to robust data protection measures, age-appropriate content filtering, and ensuring that AI systems do not pose unreasonable risks to children's safety or privacy.
  2. Transparency and Explainability: The OECD principles stress transparency, which aligns with the Child Rights principle of providing clear, understandable information to children about how AI systems work and affect them. This could involve developing child-friendly explanations of AI decision-making processes.
  3. Inclusivity and Non-discrimination: Both frameworks prioritize inclusivity and equal treatment. AI models for children's products should be trained on diverse datasets to avoid bias and ensure fair representation of all children, regardless of their background.
  4. Human-centered values: The OECD principles focus on human-centered values, which complement the child rights emphasis on respecting children's dignity and autonomy. AI systems for children should be designed to empower and support their development, not to manipulate or exploit them.
  5. Accountability and Oversight: Both sets of principles stress the importance of accountability. This means implementing strict governance structures and regular audits for children's products to ensure AI systems continue to serve children's best interests. It also involves creating mechanisms for children and their guardians to seek redress.
  6. Fostering Digital Literacy: The OECD's emphasis on building human capacity aligns with the Child Rights principle of empowering children to understand and interact safely with digital technologies. This could involve developing AI-powered educational tools that help children understand AI and its implications.
  7. Sustainable and Beneficial Development: Both frameworks aim to harness AI for positive outcomes. For children's products, this means designing AI systems that contribute to children's wellbeing, education, and healthy development while considering broader societal and environmental impacts.

By integrating these principles, companies can create AI-powered products and chatbots that comply with ethical standards and actively promote children's rights and well-being in the digital age. This approach ensures that AI becomes a tool for empowerment and positive development rather than a potential source of harm or exploitation for children.

As AI continues to advance, it is essential for AI governance professionals, policymakers, developers, and other stakeholders to review and update these principles regularly. This will ensure they remain relevant and effective in protecting children’s rights in an AI-driven world.
